Terms & Conditions
Last updated: 08/10/22026
These terms apply to all orders placed with Avoca Express through avoca-express.co.uk, by phone or in the shop. By placing an order you agree to them. Please read them before ordering.
1. About us
Avoca Express is operated by [AVOCA EXPRESS LTD] (Private limited Company / company number SC846007), 9 South Bridge Street, Airdrie, ML6 6JQ.
Contact: order@avoca-express.co.uk · 01236 762504
2. Placing an order
- When you place an order you will receive an email confirming we have received it. A contract is formed when we accept your order and start preparing it.
- We may reject or cancel an order, for example if we are too busy, an item is unavailable, the address is outside our delivery area, or we are about to close. If you have already paid, we will refund you in full.
- Please check your order, address and phone number before submitting. We are not responsible for delays caused by incorrect details.
- You must be 18 or over to order energy drinks such as Red Bull.
3. Prices and payment
- All prices are in pounds sterling and include VAT where applicable.
- Prices on our website may differ from prices on Just Eat, Uber Eats or Deliveroo. Online discounts apply to direct orders only.
- If a price is shown incorrectly because of an obvious error, we will contact you before preparing the order and you may cancel at no cost.
- You can pay by card online, or pay by cash or card when you collect. Card payments are processed securely by [Stripe / WooPayments].
4. Delivery
- We deliver within 4 miles of our shop. Delivery fees: up to 2 miles £2.50, 2–3 miles £3.00, 3–4 miles £4.00. Fees are shown at checkout before you pay.
- Delivery times are estimates. Busy periods and weather can cause delays, but we will always try to contact you if your order is running late.
- Someone must be available to receive the order. If our driver cannot reach you after trying to contact you, the order may be returned to the shop and may not be refunded.
5. Collection
- Please collect your order at the time given. Food is best enjoyed fresh, and we cannot guarantee quality if it is collected late.
- Orders not collected by closing time may be cancelled. Prepaid uncollected orders may not be refunded.
- For “pay on collection” orders, payment is due when you collect.
6. Cancellations and refunds
- Our food is freshly prepared to order, so the 14-day cancellation right under the Consumer Contracts Regulations does not apply.
- You can cancel free of charge by calling us before we start preparing your order. Once preparation has started we may not be able to cancel.
- If an item is missing, incorrect or not of satisfactory quality, please call us on 01236 762504 as soon as possible, ideally within 2 hours, and keep the food. We will offer a replacement, a partial refund or a full refund depending on the problem.
- Refunds to cards are returned to the original payment method and usually take 3–5 working days.
- This does not affect your statutory rights under the Consumer Rights Act 2015.
7. Allergens
- Our kitchen handles all 14 major allergens, including nuts, sesame, gluten, milk and egg. We cannot guarantee any dish is completely free from allergens.
- If you have an allergy, please call us on 01236 762504 before ordering and add a note to your order.
- Recipes and suppliers can change. Always tell staff about allergies each time you order.
8. Accounts
- Keep your password secure. You are responsible for orders placed through your account.
- We may suspend accounts that are misused, for example repeated fake or uncollected orders.
- You can ask us to delete your account at any time. See our Privacy Policy.
9. Offers and meal deals
Offers and meal deals are subject to availability, can be changed or withdrawn at any time, and cannot be combined with other offers unless stated.
10. Our liability
We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care. We do not exclude liability for death or personal injury caused by our negligence, or for anything else that cannot be excluded by law. We are not responsible for delays or failures caused by events outside our reasonable control.
11. Website
Photos are for illustration and dishes may vary slightly. We try to keep the website accurate and available, but cannot guarantee it will always be error-free or uninterrupted.
12. Changes and law
We may update these terms from time to time. The version on this page when you place your order applies. These terms are governed by the law of Scotland, and disputes may be brought in the Scottish courts.
13. Contact and complaints
If you have any question or complaint, please call 01236 762504 or email order@avoca-express.co.uk. We aim to respond within 2 working days.
